We are submitting these proposed measures to avoid confusion with specific country codes at the second level for each of our 8 TLDs, in relation to the individual Government objections that have been raised pertaining to the release of those specific two-character labels:

Protections

Radix understands the concern that confusion may arise, and in order to mitigate such concern is willing to offer the following:

1. Radix will commit to:

a. investigate any reports of misuse, including misleading or deceptive conduct, including those from the relevant governments that have raised concerns about the release of specific two-character labels at the second level, and provide a written report in response; and

b. where, in Radix’s sole opinion, misuse has occurred, Radix will seek to work
with the sponsoring registrar and/or directly with the registrant to address the misuse.

c. In the event that misuse continues to occur, Radix may, in its sole discretion,
undertake direct action up to and including suspension or deletion of the domain name.

1. .sky is identical to a qualifying registered trade mark;
2. .sky is not a Generic String, as this is defined in Specification 11;
3. .sky gTLD has developed and will implement a closed registration policy for .sky that requires that all domain names in the .sky gTLD be registered ONLY by the Registry Operator, its Affiliates, and its Trademark Licensees;
4. As required under the Registry Agreement, the .sky gTLD will clearly publish this registration policy;
5. .sky gTLD will conduct internal reviews at least once per calendar year to ensure continued compliance with Specification 13.
Compliance with Specification 13 prohibits the .sky gTLD from registering domain names to unaffiliated third parties and thus clearly designates to the public that .sky gTLD is a proprietary space in which all second-level domain names in the gTLD are being operated by Sky International AG, its Affiliates and Trademark Licensees and not the [GOVERNMENT] or the corresponding country code operator.

b. corresponds to that government’s country code; and
c. implies or represents that it is, or has the approval of, such government; and
2. Where, in ARSI’s sole opinion, such use has occurred, ARSI, in its sole discretion:
a. will seek to work indirectly with the sponsoring registrar and/or directly with the registrant to address such use, or
b. may cause the domain name’s records to be removed from the DNS; and
3. Provide a written response within a commercially reasonable time period.

ARSI’s Acceptable Use Policy for the TLDs will require registrants of a domain name in each of the TLDs to ensure that their use of a 2-character letter-letter combination does not imply or represent that it is, or has the approval of, any government. ARSI will reserve the right to cancel, lock, place on hold, transfer or delete the domain name in accordance with our commitment above.

Proposed Measure to Avoid Confusion—Phased Allocation

dotSucks is designed to help consumers find their voices and allow companies to find the value in criticism. Each dotSucks domain has the potential to become an essential part of every organization’s customer relationship management program.

Phased Allocation - Upon the release of the letter/letter combination corresponding to the following objected to country codes (ai, bh, bm, ci, cn, eg, gb, il, in, io, it, kr, ky, me, ms, pt, ru, sg, sh, su, tc, tw, uk), Registry Operator will provide an exclusive thirty (30) day period in which registration of such letter/letter combination will be made only available to the applicable country code manager as listed at: http://www.iana.org/domains/root/db/

This type of phased allocation has been previously approved by ICANN as an acceptable and complete measure to avoid confusion with applicable country codes.

For example, .TRAVEL included the following in its RSEP on 18 May 2009:
“In seeking to minimize any confusion with county codes, Tralliance will initially place all two-letter country code names, as listed in the ISO 31-66 list, in the RFP allocation round and will seek expressions of interest from all country code managers for their respective two-character names. Tralliance will allocate two letter country codes to any corresponding country code managers (as listed at: http://www.iana.org/domains/root/db/) that desire to register their name, with no restriction other that payment of normal registration fees and a commitment to use the registered name.”

The Board approved the change via a resolution on 5 August 2010: https://www.icann.org/resources/board- material/resolutions-2010-08-05-en.

At that time, the amendment to the .TRAVEL Registry Agreement permitted release of 2 characters through a Phased Allocation Program https://www.icann.org/resources/unthemed-pages/travel-appendix-7-2010-08-23-en).

.TRAVEL has subsequently entered into a new gTLD Registry Agreement with ICANN and carried over the previous Board- approved release of two-characters through its phased allocation program. Current .TRAVEL Specification 5 language:
“All single-character and two-character labels that were previously reserved by the Registry Operator prior to the Effective Date of this Registry Agreement may be allocated through ICANN-accredited registrars according to a phased allocation program (“Phased Allocation Program”). The domain names included within the scope of the Phased Allocation Program shall be limited to a single and two-character labels. Registry Operator reserves the right to not allocate all single and two-character labels. Pursuant to the Phased Allocation Program, Registry Operator may elect to allocate labels by applying one or more of the following processes: 1) request for proposals and allocation based on evaluation criteria; 2) auction; or 3) first come, first serve registration.”

Similar Phased Allocation Programs have been approved by ICANN as an implementation of measures to avoid confusion with corresponding country codes in .BIZ, .INFO, .ORG, and .JOBS.

Brief explanation of the TLD:
The purpose of the .SWISS TLD is to serve the Swiss community, defined as the community of individuals, legal entities and public institutions with a bona fide presence in Switzerland.
Registration of domain names under the .SWISS TLD is restricted to members of the Swiss community and subject to the further requirement that the domain name registrant’s presence in Switzerland and the registrant’s use of the domain name must comply with Swiss law.
The government of the Swiss Confederation acts as the central representative body for the Swiss community with regard to the .SWISS TLD, in consultation with the members of the Swiss community.
The measures described below address the confusion concerns cited by the governments of Anguilla, Singapore and St. Helena as well as by the Organization of African Union regarding the use of the 2-letter codes ai, sg, sh and au at the second-level of the .SWISS TLD. In the context of the .SWISS TLD, those 2-letter codes have the following meaning:
ai : official 2-letter acronym for the Swiss Canton Appenzell-Innerrhoden (see www.ai.ch)
sg : official 2-letter acronym for the Swiss Canton St-Gallen (see www.sg.ch)
sh : official 2-letter acronym for the Swiss Canton Schaffhausen (see www.sh.ch)
au : official name of the Swiss political municipality Au (see www.au.ch)

Protections:
The Swiss Confederation, as Registry Operator, has already implemented a community-based registrations policy for the .swiss TLD with particularly strict rules for all 2-letter codes. These rules were promulgated in the Federal Ordinance on Domain Names (https://www.admin.ch/opc/en/classified-compilation/20141744/index.html) and eliminate any risk of confusion. They comprise the following protections relevant to 2-letter codes:
• Each of the 26 Swiss Cantons has a single official 2-letter acronym. The Swiss Canton 2-letter acronyms are long-established, widely used and generally accepted. For instance, they appear on Swiss car license plates and are harmonized by ISO 3166-2 standard. Besides these acronyms, three Swiss political municipalities have a 2-letter name: Au, Gy and Lü.
• Only 2-letter codes matching with the official 2-letter acronym designating a Swiss Canton or matching with the official name of a Swiss political municipality will be released for registration in .SWISS.
• The 2-letter codes .SWISS domains are reserved exclusively for the respective Swiss cantonal governments, respectively for the executive council of the political municipality hence confusion due to misuse is not possible;
• A clear context specific to Switzerland is implicit with the .SWISS TLD and enforced by way of the registration policy, hence confusion with the ISO-3166 territory is not possible;
• The registration policy applying to 2-letter codes .SWISS domains is part of the Swiss legislation on domain names and published on Registry Operator’s homepage.

Process and eligibility considerations:
• The first-come-first-served principle is not applied for the allocation of .swiss domain names. As a principle, every allocation of domain name is based on an evaluation. Once a .swiss domain name application is submitted, the Registry will examine if the requested domain name is available and if the application meet the syntax rules and the general eligibility requirements set forth in the registration policy.
• The community-based eligibility and name selection criteria of the .swiss registration policy described above would also prevent the governments of Anguilla, Singapore and St. Helena as well as the Organization of African Union from registering 2-letter codes domains in the .SWISS TLD.

b. ensuring that the use of the domain name, where that domain name is a two letter Label that corresponds to a country code described in the ISO 3166-1 alpha-2 standard, avoids confusion with the corresponding country code;…”

Should a Registrant fail to comply with the Acceptable Use Policy, the domain name may be cancelled, locked, placed on hold, transferred or deleted. Thus all Registrants in the TLDs, have an obligation to avoid confusion with two letter country codes and we have clear penalties for any failure to do so.

3. Should a Registrant fail to comply with the Acceptable Use and Take down Policy, the domain names may be cancelled, locked, placed on hold, transferred or deleted. Thus, all Registrants in the TLDs, including ourselves, have an obligation to avoid confusion with two letter country codes and we have clear penalties for any failure to do so.

Russia objects the release of Two-Character combination “.su” at the second level under any kind/all gTLD.
We are concerned that the deceptive similarity of these two-letter combinations with country codes ccTLDs creates the risk of confusion and misleading of Internet users.
This requirement should apply to all current and future requests.

Domain Name System
Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots"").
