NordNet SA 公司数据留存弃权申请

NordNet SA 公司("注册服务机构")已按照《2013 RAA》的《数据留存规格》第 3 节的规定,向 ICANN 提交了《注册服务机构数据留存弃权申请》(简称"弃权申请")。本规定指出,在 ICANN 按照《2013 RAA》的规定已经发放了一份数据留存弃权书,若另有一名注册服务机构处在该弃权书发放的同一司法管辖区内,则该注册服务机构可申请 ICANN 发放一份类似的弃权书,而 ICANN 则应批准该弃权申请。但 ICANN 向注册服务机构给出不批准的合理理由的情况除外。

本注册服务机构在弃权申请中指出,鉴于 OVH SAS 公司、Mailclub SAS 公司、Gandi SAS 公司和 Online SAS 公司申辩这些公司若遵守《2013 RAA》数据留存规格中的数据搜集和/或留存要求则将违反法国的适用法律,因此 ICANN 已向上述公司发放了数据留存弃权书。

鉴于本注册服务机构与上述注册服务机构均属法国境内公司,适用于法国法律,鉴于此,ICANN 决定可以向本注册服务机构发放一份类似于已向 OVH SAS 公司、Mailclub SAS 公司、Gandi SAS 公司和 Online SAS 公司发放的数据留存弃权书。

ICANN 现向该注册服务机构发放一份限制性弃权书,允许该注册服务机构按照以下条件无须遵守《2013 RAA》中的某些条款:

  1. ICANN 同意,自该注册服务机构执行《2013 RAA》起,在评估该注册服务机构是否遵守《2013 RAA》数据留存规格第 1.1 段中的数据留存要求方面,现将数据留存规格第 1.1 段中的"额外两年"修订为"额外一年"。
  2. 数据留存规格的其他条款均保持不变。该弃权书仅许可该注册服务机构调整针对数据留存规格第 1.1.1 段至 1.1.8 段中列出数据的到期留存期,但并不代表该注册服务机构可不遵守《2013 RAA》的其他条款或适用于注册服务机构的其他 ICANN 政策。在对上文不做出任何限制的情况下,本弃权书中的任何内容不得限制注册服务机构遵守按照 ICANN 章程("ICANN 政策")而制定并推行的共识性政策或临时性政策的义务,或限制注册服务机构遵守按照《2013 RAA》的条款而对《2013 RAA》做出的修订、增补或调整(简称"RAA 修订案")的义务。若本弃权书和任何 ICANN 政策或 RAA 修订案之间存有出入,应以 ICANN 政策或 RAA 修订案的条款为主。
  3. 该注册服务机构所获弃权书的有效期与该注册服务机构签署的《2013 RAA》的有效期相同。

ICANN 指出本规格第 3 节中的条款还将适用于需要遵守法国法律的法国其他注册服务机构提出的类似弃权请求。

Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots""). The ASCII form of an IDN label is termed an ""A-label"". All operations defined in the DNS protocol use A-labels exclusively. The Unicode form, which a user expects to be displayed, is termed a ""U-label"". The difference may be illustrated with the Hindi word for ""test"" — परीका — appearing here as a U-label would (in the Devanagari script). A special form of ""ASCII compatible encoding"" (abbreviated ACE) is applied to this to produce the corresponding A-label: xn--11b5bs1di. A domain name that only includes ASCII letters, digits, and hyphens is termed an ""LDH label"". Although the definitions of A-labels and LDH-labels overlap, a name consisting exclusively of LDH labels, such as""icann.org"" is not an IDN."
