The following is a summary of discussions, actions taken, and actions identified:

  1. Reconsideration Request 18-8 The Committee received a briefing on Reconsideration Request 18-8, which was submitted by Afilias Domains No. 3 Ltd. (Requestor), seeking reconsideration of ICANN organization's response to the Requestor's request for documents, pursuant to ICANN's Documentary Information Disclosure Policy (DIDP), relating to the .WEB contention set. The Requestor claims that, in declining to produce certain requested documents, ICANN org violated the DIDP and its Core Values and commitments established in the Bylaws concerning transparency and openness. Pursuant to Article 4, Section 4.2(l) of the Bylaws, ICANN org transmitted Request 18-8 to the Ombudsman for consideration, and the Ombudsman recused himself. After discussion, the BAMC determined that ICANN org adhered to established policies and procedures in its DIDP Response and did not violate its commitments established in the Bylaws concerning transparency and openness. The BAMC agreed that the draft recommendation should be revised to incorporate one change and then circulate to the BAMC for its consideration.
    • Action: ICANN org to revise draft recommendation and circulate to BAMC for its consideration.
  2. Update re next steps on Asia Green IT System Bilgisayar San. ve Tic. Ltd. Sti. (AGIT) v. ICANN IRP Final Declaration (.HALAL/.ISLAM) and Gulf Corporation Council (GCC) v. ICANN Independent Review Process (IRP) Final Declaration (.PERSIANGULF) The Committee discussed the next steps that the Board has requested the BAMC to take related to these two IRP matters. The BAMC requested that it be provided with possible options of next steps for consideration by the BAMC in order for the Committee to make its recommendations to the Board, by ICANN 63, if feasible.
    • Action: ICANN org to provide recommended options of paths forward to the BAMC for its consideration.
  3. Update on Pending Reconsideration Requests relating to Community Priority Evaluation (CPE) The BAMC received an update on the pending Reconsideration Requests relating to CPE, including the status of remaining oral presentation to be presented to the BAMC as requested by the Requestors.
  4. Litigation Update The BAMC received a litigation update.
