ingenit GmbH & Co. KG公司("注册商")已向ICANN提交了《注册商数据留存弃权申请》(简称"弃权申请"),申辩该注册商若遵守《2013 RAA》数据留存规格(简称"本规格")中的数据搜集和/或留存要求则将违反德国的适用法律。

ICANN现向该注册商发放一份限制性弃权书,允许该注册商在以下条件下无须遵守《2013 RAA》中的某些条款:

  1. ICANN对以下内容表示许可:

    (a)注册商在其向某注册提供支持服务期间及该期间结束后的两(2)年内,仍将负责留存本规格第1.1.1节至第1.1.8节中指定的数据元素;但允许该注册商根据适用法律中的禁用规定,对本规格第1.1.1节至第1.1.8节中指定的数据元素进行禁用。(在《德意志联邦数据保护法》(Bundesdatenschutzgesetz——简称"BDSG")第35节第2句中规定的数据主体的权利保持不变的情况下,请在本注册支持期间结束一年后尽早查看BDSG第35节第3段的内容)

    (b)注册商可无需遵守本规格第1.2.2节至1.2.3节中指定数据元素的留存义务,该内容还等同于《德国电信媒体法》(Telemediengesetz——简称"TMG")第13节第4段第2句中有关数据使用的部分。但若在法律或规章中、或在注册局和注册商订立的合同中已经确定了该类数据的留存期间,则应按照TMG第13节第4段第2点中的第2句话对该数据进行留存。

    (c)在BDSG第35段第2句中有关数据主体的权利保持不变的情况下,注册商可在某一注册的服务支持期间结束一年后,尽早根据适用法律(请参见BDSG第35节第3段)中的禁用规定,对第1.2.1节、第1.2.2节和第1.2.3节中的指定数据元素进行禁用。

    (d)在满足BDSG第35节第8段中规定的例外要求的情况下,允许在尚未获得数据主体许可的情况下转移任何留存的禁用数据元素。

  2. 本规格中的其他条款均保持不变。该弃权书仅许可该注册商调整针对本规格第1.1.1段至1.1.8段和第1.2.1段至1.2.3段中列出数据的到期留存期,但并不代表该注册商可不遵守《2013 RAA》的其他条款或适用于注册商的其他ICANN政策。在对上文不作出任何限制的情况下,本弃权书中的任何内容不得限制注册商遵守按照ICANN章程("ICANN政策")而制定并推行的共识性政策或临时性政策的义务,或限制注册商遵守按照《2013 RAA》的条款而对《2013 RAA》做出的修订、增补或调整(简称"RAA修订案")的义务。若本弃权书和任何ICANN政策或RAA修订案之间存有出入,应以ICANN政策或RAA修订案的条款为主。

  3. 该注册商所获弃权书的有效期与该注册商签署的《2013 RAA》的有效期相同。

ICANN指出本规格第3节中的条款还将适用于需要遵守德国法律的德国其他注册商提出的类似弃权请求。

Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots""). The ASCII form of an IDN label is termed an ""A-label"". All operations defined in the DNS protocol use A-labels exclusively. The Unicode form, which a user expects to be displayed, is termed a ""U-label"". The difference may be illustrated with the Hindi word for ""test"" — परीका — appearing here as a U-label would (in the Devanagari script). A special form of ""ASCII compatible encoding"" (abbreviated ACE) is applied to this to produce the corresponding A-label: xn--11b5bs1di. A domain name that only includes ASCII letters, digits, and hyphens is termed an ""LDH label"". Although the definitions of A-labels and LDH-labels overlap, a name consisting exclusively of LDH labels, such as""icann.org"" is not an IDN."
