数据留存弃权申请——TransIP B.V.公司

TransIP B.V.公司("注册服务机构")向 ICANN 提交了一份《注册服务机构数据留存弃权申请》(简称"弃权申请"),申辩该注册服务机构若遵守《2013 RAA》数据留存规格中的数据搜集和/或留存要求则违反了荷兰的适用法律。

ICANN 现向该注册服务机构发放一份限制性弃权书,允许该注册服务机构按照以下条件无须遵守《2013 RAA》中的某些条款:

  1. 根据注册服务机构执行《2013 RAA》时,考虑到本《弃权申请》中第 2 节和第 3 节的条款内容,为了评估注册服务机构是否遵守了《数据留存规格》第 1.2.2 节和第 1.2.3 节中的数据留存要求,ICANN 同意:
    1. 本规格中第 1.2.2 节和第 1.2.3 节中列出的留存要求不应适用于日志文件;和
    2. 第 1.2.2 节中的留存要求不应适用于电话号码、源 IP 地址和 HTTP 抬头。
  2. 尽管上文已经陈述,但有关《数据留存规格》第 1.2.2 节中有关 HTTP 抬头的规定,以下弃权申请例外情况适用于:在任何通过浏览器(而非电子邮件)访问注册人的情况下,注册服务机构可决定(但并无义务)存储该 HTTP 请求和响应,从而为针对注册人的访问行为保存证据。如果 HTTP 的请求和响应通过这种方式储存,则根据《数据留存规格》,注册服务机构的留存义务(以及《2013 RAA》中涉及的其他义务)应完全适用于这类信息。

  4. 数据留存规格的其他条款均保持不变。该弃权书仅许可该注册服务机构调整本《弃权申请》中明示规定的、针对《数据留存规格》第 1.2.2 节至 1.2.3 节中列出的具体数据项目的留存期,但并不代表该注册服务机构可不遵守《2013 RAA》的其他条款或适用于注册服务机构的其他 ICANN 政策。在对上文不做出任何限制的情况下,本弃权书中的任何内容不得限制注册服务机构遵守按照 ICANN 章程("ICANN 政策")而制定并推行的共识性政策或临时性政策的义务,或限制注册服务机构遵守按照《2013 RAA》的条款而对《2013 RAA》做出的修订、增补或调整(简称"RAA 修订案")的义务。若本弃权书和任何 ICANN 政策或 RAA 修订案之间存有出入,应以 ICANN 政策或 RAA 修订案的条款为主。
  5. 该注册服务机构所获弃权书的有效期与该注册服务机构签署的《2013 RAA》的有效期相同。

ICANN 指出本规格第 3 节中的条款还将适用于需要遵守荷兰法律的荷兰其他注册服务机构提出的类似弃权请求。

Domain Name System
Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots""). The ASCII form of an IDN label is termed an ""A-label"". All operations defined in the DNS protocol use A-labels exclusively. The Unicode form, which a user expects to be displayed, is termed a ""U-label"". The difference may be illustrated with the Hindi word for ""test"" — परीका — appearing here as a U-label would (in the Devanagari script). A special form of ""ASCII compatible encoding"" (abbreviated ACE) is applied to this to produce the corresponding A-label: xn--11b5bs1di. A domain name that only includes ASCII letters, digits, and hyphens is termed an ""LDH label"". Although the definitions of A-labels and LDH-labels overlap, a name consisting exclusively of LDH labels, such as""icann.org"" is not an IDN."
