数据留存弃权申请——Online SAS公司

Online SAS公司("注册商")已按照《2013 RAA》的《数据留存规格》第3节的规定,向ICANN提交了《注册商数据留存弃权申请》(简称"弃权申请")。本规定指出,在ICANN按照《2013 RAA》的规定已经发放了一份数据留存弃权书,若另有一名注册商处在该弃权书发放的同一司法管辖区内,则该注册商可申请ICANN发放一份类似的弃权书,而ICANN则应批准该弃权申请。但ICANN向注册商给出不批准的合理理由的情况除外。

本注册商弃权申请中指出,鉴于OVH SAS公司、MAILCLUB SAS公司和GANDI SAS公司申辩该注册商若遵守《2013 RAA》数据留存规格中的数据搜集和/或留存要求则将违反法国的适用法律,因此ICANN已向上述公司发放了一份数据留存弃权书。




鉴于本注册商与OVH SAS公司、MAILCLUB SAS公司和GANDI SAS公司同属处在法国境内的简易股份公司,适用于法国法律,因此,ICANN决定,在已向上述公司发放弃权书的情况下,可向本注册商发放一份类似的数据留存弃权书。

ICANN现向该注册商发放一份限制性弃权书,允许该注册商按照以下条件无须遵守《2013 RAA》中的某些条款:

  1. ICANN同意,自该注册商执行《2013 RAA》起,在评估该注册商是否遵守《2013 RAA》数据留存规格第1.1段中的数据留存要求方面,现将数据留存规格第1.1段中的"额外两年"修订为"额外一年"。

  2. 数据留存规格的其他条款均保持不变。该弃权书仅许可该注册商调整针对数据留存规格第1.1.1段至1.1.8段中列出数据的到期留存期,但并不代表该注册商可不遵守《2013 RAA》的其他条款或适用于注册商的其他ICANN政策。在对上文不做出任何限制的情况下,本弃权书中的任何内容不得限制注册商遵守按照ICANN章程("ICANN政策")而制定并推行的共识性政策或临时性政策的义务,或限制注册商遵守按照《2013 RAA》的条款而对《2013 RAA》做出的修订、增补或调整(简称"RAA修订案")的义务。若本弃权书和任何ICANN政策或RAA修订案之间存有出入,应以ICANN政策或RAA修订案的条款为主。

  3. 该注册商所获弃权书的有效期与该注册商签署的《2013 RAA》的有效期相同。

Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots""). The ASCII form of an IDN label is termed an ""A-label"". All operations defined in the DNS protocol use A-labels exclusively. The Unicode form, which a user expects to be displayed, is termed a ""U-label"". The difference may be illustrated with the Hindi word for ""test"" — परीका — appearing here as a U-label would (in the Devanagari script). A special form of ""ASCII compatible encoding"" (abbreviated ACE) is applied to this to produce the corresponding A-label: xn--11b5bs1di. A domain name that only includes ASCII letters, digits, and hyphens is termed an ""LDH label"". Although the definitions of A-labels and LDH-labels overlap, a name consisting exclusively of LDH labels, such as"""" is not an IDN."
