身为注册域名持有人(注册人),您将享有某些特定权利,包括有人依据UDRPURS对域名注册提出争议或质疑时进行自我辩护的权利。以下程序旨在规范商标持有人解决域名抢注及其他各类商标相关滥用域名注册争议的流程;但是,如果认定自身出于合法使用目的并秉承真诚原则注册域名,建议您及时对 UDRP 或 URS 投诉做出回应,务必真实反映自身情况。

  1. 统一域名争议解决政策 (UDRP) 和统一快速中止程序 (URS) 系统属于行政诉讼程序。如果希望恢复或取消 (UDRP) 涉嫌抢注的域名或中止 (URS) 涉嫌抢注的域名,商标持有人可能会依据上述两项程序向您发起投诉。UDRP 适用于任何通用顶级域 (gTLD) 注册域名。URS 适用于注册协议 (RA) 包含有关/对应选项的 gTLD 注册域名。一些分配给特定国家/地区的国家和地区顶级域(ccTLD,如 .cn 代表中国、.in 代表印度等)也采用这些争议诉讼程序或其变体形式。如果陷入争议的域名属于 ccTLD,请联系 ccTLD 经理人以获取适用信息。
  2. 值得注意的是,UDRP 或 URS 投诉由发起投诉的一方("投诉人")负责举证。如果向您("被诉人")发起 URS 或 UDRP 投诉,为在案件中胜诉,投诉人必须证明符合三项投诉标准。首先,必须证明自身享有身为某个独特标志所有者的各项商标权利,而且一直在使用该标志。同时,还需证明依据 UDRP 或 URS 发起投诉的域名与自身的合法商标完全相同或极易混淆。另外还必须证明:您恶意注册域名;您恶意使用域名;您不具备域名权利,也无权享受合法权益。如果认定投诉人无法证明向您发起投诉的全部三项标准 - 务必对提交的争议做出响应并进行自我辩护!
  3. 我们将根据您在注册域名时提供的联系信息发出通知,说明有关诉讼的开始时间及回应时间。因此,这也是获取注册人最新联系信息十分关键的另一个原因。您将需要在规定的时间内做出回应(UDRP:20 天;URS:14 天。但在某些情况下,也可以授权延长时间)。不支持面对面听证(除非 UDRP 案件需要专家组做出特殊裁定)。即使未予记录,也需提起诉讼以裁定案件。
  4. 无需律师对 UDRP 或 URS 做出回应;但是,建议您聘请代理律师,因为上述两项流程的规则十分繁琐。另外,律师还可根据投诉和诉讼程序结果提供商标法信息,指导如何最有效地做出回应及采取行动。
  5. 如果投诉人胜诉,UDRP 专家组将勒令取消域名或将域名转让给投诉人。在 URS 投诉中,如果投诉人胜诉,专家组将勒令注册期内的剩余时间中止使用域名。URS 旨在裁定明确的商标侵权案件;因此相较于 UDRP,URS 程序处理速度更快、费用也更低。发起 URS 投诉将导致域名在争议处理过程中遭到锁定,因而诉讼期间不可对域名注册做出非授权更改。

Domain Name System
Internationalized Domain Name ,IDN,"IDNs are domain names that include characters used in the local representation of languages that are not written with the twenty-six letters of the basic Latin alphabet ""a-z"". An IDN can contain Latin letters with diacritical marks, as required by many European languages, or may consist of characters from non-Latin scripts such as Arabic or Chinese. Many languages also use other types of digits than the European ""0-9"". The basic Latin alphabet together with the European-Arabic digits are, for the purpose of domain names, termed ""ASCII characters"" (ASCII = American Standard Code for Information Interchange). These are also included in the broader range of ""Unicode characters"" that provides the basis for IDNs. The ""hostname rule"" requires that all domain names of the type under consideration here are stored in the DNS using only the ASCII characters listed above, with the one further addition of the hyphen ""-"". The Unicode form of an IDN therefore requires special encoding before it is entered into the DNS. The following terminology is used when distinguishing between these forms: A domain name consists of a series of ""labels"" (separated by ""dots""). The ASCII form of an IDN label is termed an ""A-label"". All operations defined in the DNS protocol use A-labels exclusively. The Unicode form, which a user expects to be displayed, is termed a ""U-label"". The difference may be illustrated with the Hindi word for ""test"" — परीका — appearing here as a U-label would (in the Devanagari script). A special form of ""ASCII compatible encoding"" (abbreviated ACE) is applied to this to produce the corresponding A-label: xn--11b5bs1di. A domain name that only includes ASCII letters, digits, and hyphens is termed an ""LDH label"". Although the definitions of A-labels and LDH-labels overlap, a name consisting exclusively of LDH labels, such as""icann.org"" is not an IDN."
