Concurrent Agreement

The Internet Corporation for Assigned Names and Numbers, a California non-profit, public benefit corporation ("ICANN"), and Network Solutions, Inc. Registrar, a Delaware corporation ("Registrar"), have entered into a Registrar Accreditation Agreement, deemed made on May 17, 2001, ("Registrar Accreditation Agreement"), with which this Concurrent Agreement ("Concurrent Agreement") is concurrently executed and intended to coexist.

Registrar wishes to be accredited by ICANN pursuant and subject to the Registrar Accreditation Agreement and ICANN wishes to accredit registrar. Accordingly, Registrar and ICANN hereby agree as follows:

1. Approval of Variable Accreditation Fee. For so long as Registrar is an ICANN-Accredited Registrar in the .com, .net or .org TLD, Registrar will approve the variable accreditation fee, as provided in Subsection 3.9.2 of the Registrar Accreditation Agreement, for so long as Registrar's portion does not exceed $2,000,000 annually.

2. Concurrent Agreement. ICANN and Registrar expressly agree that this Concurrent Agreement is a written agreement executed by both parties concurrently with the execution of the Registrar Accreditation Agreement, as included in Subsection 5.16(a) thereof, and shall be enforceable notwithstanding that Subsection's provision superseding certain prior agreements.

3. Definitions. All initially capitalized terms not otherwise defined herein shall have the definitions assigned to such terms in the Registrar Accreditation Agreement.

IN WITNESS WHEREOF, the parties hereto have caused this Concurrent Agreement to be executed in duplicate by their duly authorized representatives.
